Terms & Conditions

These User Terms are agreed between ZikPe and the Users, and govern the use of the App and Services provided by ZikPe. Nothing in these User Terms is intended to confer upon either ZikPe or the User any right, power, or authority, whether express or implied, to create any duty or obligation on behalf of the other party.

These User Terms constitute a principal-to-principal relationship between ZikPe and the Users and do not attempt to create any agency relationship. The Services are being rendered by ZikPe as an independent entity and nothing contained herein shall be deemed to create any association, partnership, joint venture or relationship of principal and agent or master and servant, or employer and employee between ZikPe and the Users hereto or any affiliates or subsidiaries thereof or to provide either ZikPe or the User with the right power or authority, whether express or implied to create any such duty or obligation on behalf of the other party, i.e. either ZikPe or the User.

ZikPe may assign in whole or in part the benefits or obligations of these User Terms to its associates or affiliates or other group company, or any other company, in circumstances including but not limited to pursuant to a restructuring or re-organization or demerger of its or something of the nature. ZikPe shall not require approval or consent of the User. ZikPe can at its discretion provide an intimation of such assignment to the Users. However, the User shall not assign, in whole or in part, the benefits or obligations of these User Terms, without the prior written permission of ZikPe.

ZikPe shall not be liable for its failure to perform under these User Terms as a result of occurrence of any force majeure events like acts of God, fire, wars, sabotage, civil unrest, labor unrest, action of statutory authorities or local or central governments, change in laws, rules and regulations, affecting the performance of ZikPe, payment gateways or Merchant.

Unless otherwise expressly stated, failure to exercise or delay in exercising a right or remedy hereunder shall not constitute a waiver of the right or remedy or a waiver of any other rights or remedies, and no single or partial exercise of any right or remedy, hereunder shall prevent any further exercise of the right or remedy or the exercise of any other right or remedy.

The terms and provisions of these User Terms by their nature and content are intended to survive the performance hereof by any or all parties hereto shall so survive termination.

If any provision, hereunder becomes, in whole or in part, invalid or unenforceable but would be valid or enforceable if some part of that provision was deleted, that provision shall apply with such deletions as may be necessary to make it valid. If any court/tribunal of competent jurisdiction holds any of the provisions, hereunder unlawful or otherwise ineffective, the remainder shall remain in full force and the unlawful or otherwise ineffective provision shall be substituted by a new provision reflecting the intent of the provision so substituted.

The User warrants that it shall not directly or indirectly solicit for employment, nor offer employment to nor enter into any contract of services with any person employed by ZikPe.

By clicking on the tab/button/checkbox of ZikPe option or any other button/checkbox/confirmation of similar nature or by the virtue of usage of App and Services or continued usage thereof:

You confirm that you are eligible under applicable law to contract;

You consent to conduct transactions, accept these User Terms as displayed on the App;

You consent to receive communications, notices and information from us physically/electronically, whether by email or other electronic means.

It is agreed and clarified that the arrangement set out by these User Terms between ZikPe and Users is on a non-exclusive basis.

Wallet Maintenance Fee

A ₹399 maintenance fee per month will be levied on any wallet that remains inactive for a continuous period of thirty (30) days or has no top-up during this period. This policy shall be effective from 6th October 2025.

Wallet Closure Fee

On wallet closure, a fee of ₹399 will be charged. This policy shall be effective from 6th October 2025.

By using ZikPe, you agree that you shall not:

False Information

Provide false, inaccurate, or misleading information during registration, KYC, or at any time while using the Services.

Unlawful Use

Use the App or wallet for any unlawful purpose, including money laundering, terrorist financing, fraud, or circumvention of applicable foreign exchange or RBI regulations.

Unauthorized Access

Attempt to gain unauthorized access to ZikPe systems, other users' accounts, or any part of the Services.

Third-Party Transactions

Use the App to transact on behalf of any third party without authorization.

Tampering

Reverse engineer, decompile, or interfere with the App's security features.

Violation of this section may result in immediate suspension or termination of your account, forfeiture of wallet balance in accordance with applicable law, and reporting to relevant regulatory or law enforcement authorities. ZikPe reserves the right to initiate civil or criminal legal proceedings against any User found to be in violation of this section, including but not limited to claims for recovery of losses, damages, and legal costs incurred by ZikPe as a result of such violation, without prejudice to any other rights or remedies available to ZikPe under applicable law.

To the maximum extent permitted by applicable law, ZikPe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App or Services, including but not limited to loss of funds due to user error, third-party payment gateway failure, network outages, or unauthorized access resulting from the User's failure to safeguard login credentials or OTPs.

ZikPe's total liability arising out of or relating to these User Terms, whether in contract, tort, or otherwise, shall not exceed the transaction value directly in dispute, or ₹10,000, whichever is lower, except where such limitation is prohibited by applicable law or RBI regulations governing Prepaid Payment Instruments.

You agree to indemnify and hold harmless ZikPe, its affiliates, officers, and employees from any claims, losses, liabilities, damages, or expenses (including reasonable legal fees) arising out of your breach of these User Terms, your misuse of the App or Services, or your violation of any applicable law or third-party rights.

ZikPe reserves the right to suspend or terminate your account and access to the Services, with or without prior notice, if:

Breach

You breach these User Terms or applicable law.

KYC Failure

KYC verification fails, is incomplete, or is found to be fraudulent.

Suspicious Activity

Your account shows suspicious or potentially fraudulent activity.

Regulatory Requirement

Required by a regulatory authority, court order, or law enforcement request.

You may close your account at any time by submitting a request through the App or by contacting support@zikpe.com, subject to the Wallet Closure Fee described in Section 2.1 and settlement of any outstanding balance in accordance with applicable RBI PPI guidelines.

These User Terms shall be governed by and construed in accordance with the laws of India. Subject to the grievance redressal process described in Section 2.7, any dispute arising out of or in connection with these User Terms shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana.

Any complaints or grievances regarding the Services may be raised with our Grievance Officer at support@zikpe.com. We will endeavor to resolve your grievance within a reasonable timeframe in accordance with applicable RBI guidelines.

If your grievance remains unresolved, you may escalate the matter to the Reserve Bank of India under the RBI Integrated Ombudsman Scheme, details of which are available at https://cms.rbi.org.in.

ZikPe does not authorize any third party, website, mobile application, social media account, or communication channel other than the official ZikPe App and the channels listed at zikpe.com to act on its behalf. Users are solely responsible for verifying the authenticity of any communication, application, or platform claiming to represent ZikPe before sharing personal information, OTPs, KYC documents, or making any payment.

ZikPe shall not be liable for any loss, damage, or unauthorized transaction arising from a User's interaction with any fraudulent, unauthorized, or impersonating website, application, or communication claiming to be ZikPe or affiliated with ZikPe, including but not limited to phishing, smishing (SMS phishing), vishing (voice phishing), or fake customer support numbers, except where such loss arises from ZikPe's own negligence, including a breach or leak of User data from ZikPe's systems.

Users are strongly advised to download the App only from official app stores (Google Play Store, Apple App Store) and to report any suspected impersonation or phishing attempt to support@zikpe.com immediately.

ZikPe shall not be liable for any loss, damage, or harm arising from AI-generated images, deepfake videos, synthetic voice recordings, or any other manipulated or fabricated media falsely depicting ZikPe, its officers, employees, or representatives, whether used to promote fraudulent schemes, solicit payments, or impersonate official communications. ZikPe does not create, authorize, or endorse any such content.

Users must transact and access services only through the official ZikPe mobile application and the official website at https://zikpe.com. ZikPe does not operate, authorize, or take responsibility for any similarly named, deceptively spelled, or lookalike domains, applications, or handles (including but not limited to domains using alternate characters, symbols, or spellings resembling "zikpe.com", such as "zikpe.co", "z1kpe.com" or similar variants), regardless of how closely they resemble ZikPe's official branding.

Users are advised to independently verify the URL, app publisher name, and official communication channels before entering any personal, financial, or KYC information. ZikPe shall not be liable for any loss arising from a User's interaction with such unauthorized, deceptive, or fraudulent platforms, except where such loss arises from ZikPe's own negligence, including a breach or leak of User data from ZikPe's systems.
